Zavod Open je skupaj s partnerjema Danes je nov dan in Inštitutom za druga vprašanja izvedel hitro akcijo, namenjeno zagovarjanju javnega interesa pri regulaciji kratkoročnega oddajanja nepremičnin. Predlog Zakona o gostinstvu (ZGos-1), ki ureja delovanje platform, kot je Airbnb, vstopa v zakonodajni postopek, pri čemer se sooča z močnim nasprotovanjem interesnih skupin sobodajalcev. Ti v javnosti in med odločevalci širijo trditve o protiustavnosti predloga zakona, kar ogroža njegovo sprejetje – kljub temu, da bi ureditev bistveno prispevala k reševanju stanovanjske krize in dostopnosti stanovanj.

Projekt je zato okrepil glas civilne družbe v javni razpravi ter ustvaril strokovne podlage za bolj uravnoteženo odločanje. Osrednje aktivnosti so vključevale pripravo celovite pravne analize ustavnosti predloga zakona, povezovanje z relevantnimi deležniki, intenzivno zagovorniško delo ter širok nabor komunikacijskih aktivnosti – od spletnih objav do novinarske konference.

Kaj smo dosegli

  • Izvedena je bila celovita pravna analiza, ki je okrepila zagovorniške kapacitete in argumentirano ovrgla očitke o protiustavnosti predloga zakona.
  • Okrepljene so bile zmogljivosti nevladnih organizacij za učinkovito sodelovanje v zakonodajnem procesu.
  • Povečana je bila ozaveščenost javnosti o vplivu kratkoročnega oddajanja na stanovanjsko krizo, kar potrjuje več kot 40 medijskih objav, 81.000 spletnih ogledov, 6.600 obiskov povezanih strani, izvedena novinarska konferenca in javni dogodek.
  • Vzpostavljena je bila koalicija s petimi ključnimi deležniki, izvedeni so bili sestanki s koalicijskimi poslanci in organiziran dogodek s predstavniki dveh ministrstev, kar je okrepilo ter usmerilo nadaljnji dialog z odločevalci.

Zavod Open, together with its partners Danes je nov dan and the Institute for Other Questions, carried out a rapid-response action aimed at defending the public interest in the regulation of short-term property rentals. The proposed Hospitality Act (ZGos-1), which regulates the operation of platforms such as Airbnb, has entered the legislative process while facing strong opposition from interest groups representing short-term rental providers. These groups have been spreading claims among the public and decision-makers that the proposed law is unconstitutional, thereby jeopardising its adoption—despite the fact that the regulation would make a significant contribution to addressing the housing crisis and improving housing affordability.

The project therefore strengthened the voice of civil society in the public debate and provided an expert foundation for more balanced decision-making. Key activities included the preparation of a comprehensive legal analysis of the constitutionality of the proposed law, networking with relevant stakeholders, intensive advocacy efforts, and a wide range of communication activities—from online outreach to a press conference.

What we achieved

  • A comprehensive legal analysis was carried out, strengthening advocacy capacities and providing well-founded arguments to refute claims that the proposed law is unconstitutional.
  • The capacities of civil society organisations were strengthened to enable more effective participation in the legislative process.
  • Public awareness of the impact of short-term rentals on the housing crisis was increased, as evidenced by more than 40 media articles, 81,000 online views, 6,600 visits to related websites, a press conference, and a public event.
  • A coalition of five key stakeholders was established, meetings were held with coalition MPs, and an event involving representatives of two ministries was organised, thereby strengthening and structuring ongoing dialogue with decision-makers.
