Trenutno vlada RS pripravlja dva zakonska predloga, ki naj bi urejala področje solastništva zaposlenih, in sicer: Predlog Zakona o lastniški zadrugi delavcev (ZLZD ali t.i. ESOP zakon), ki sta ga pripravila Ministrstvo za solidarno prihodnost (MSP) in Ministrstvo za delo, družino in socialne zadeve (MDDSZ), in novelo Zakona o udeležbi delavcev pri dobičku (ZUDOND), ki spodbuja delitev dobička med zaposlene, v pripravi Ministrstva za gospodarstvo, turizem in šport (MGTŠ). Na Inštitutu za ekonomsko demokracijo (IED) opozarjamo, da novela zakona, ki ga predlaga MGTŠ, v očeh neinformirane javnosti le na videz pravno ureja področje lastništva zaposlenih, v praksi pa ne ponuja rešitve za problem nasledstva ter sistemsko in trajnostno ureditev področja. Odločevalci so v javnosti že večkrat povedali, da sta si zakonska predloga konkurenčna, predlog zakona MGTŠ pa je že sedaj medijsko bolje pokrivan, zato lahko sklepamo, da obstaja realna nevarnost, da bi se v obravnavi politični odločevalci osredotočili zgolj na sprejem predloga MGTŠ. Na IED menimo, da je razlog za slabšo medijsko pokritost in izraženo podporo predlogu ZLZD to, da ta uvaja model ESOP, ki je slovenski javnosti manj poznan in bolj tehnično zahteven za razliko od modela, ki ga uvaja predlog ZUDOND, čeprav bi sprejetje ZLZD  v praksi pomenilo dejansko sistemsko ureditev področja lastništva. Zato smo na IED mnenja, da je ozaveščanje o modelu ESOP in predlogu zakona ZUDOND med relevantnimi deležniki in odločevalci prvi korak pri pridobivanju podpore in opolnomočenju deležnikov in koristnikov zakona v zagovorništvu in podpori zakonu.  Z ozaveščevalno-zagovorniško akcijo, želimo da predlog zakona ZLZD vlada pripelje do javne obravnave in za tem do sprejetja zakona, zato na IED ocenjujemo, da je organiziran, javni pritisk na odločevalce, nujen da le ti prepoznajo potrebo in nujnost sprejetja ZLZD.

DOSEŽKI:

Ustanovili smo Koalicijo za solastništvo zaposlenih z vsaj 5 začetnimi člani (1 nevladna organizacija/podjetniška organizacija, 1 lokalni deležnik, 1 iz finančnega sektorja, 1 podjetnik, 1 akademik). Pridobili smo 15 dodatnih podpisnikov podpornega pisma in podpornikov koalicije. Izdali smo dva novičnika za promocijo koalicije in podpore zakonu.

Oblikovali in promovirali smo spletno stran Koalicije za lastništvo zaposlenih, objavili smo 15 multimedijskih objav v sklopu spletne zagovorniške kampanje za omrežja Linkedin in Instagram, in objavili medijske prispevke o podpornikih. Predstavili smo zakon in koalicijo na javnem dogodku z vsaj 100 deležniki.

Currently, the Slovenian government is preparing two legislative proposals aimed at regulating employee ownership: the Draft Law on Workers' Ownership Cooperatives (ZLZD or the so-called ESOP law), prepared by the Ministry for Solidarity Future (MSP) and the Ministry of Labour, Family, Social Affairs (MDDSZ), and the amendment to the Law on Employee Profit Participation (ZUDOND), which promotes profit sharing among employees, being prepared by the Ministry of Economic Development, Tourism, and Sport (MGTŠ). At the Institute for Economic Democracy (IED), we note that the amendment proposed by the MGTŠ seems to superficially regulate employee ownership in the eyes of an uninformed public, but in practice, it does not offer solutions for succession or systemic and sustainable regulation. Decision-makers have repeatedly stated in public that the two legislative proposals are competitive; however, the MGTŠ proposal is already more widely covered in the media, indicating a real risk that political decision-makers may focus solely on the adoption of the MGTŠ proposal. At the IED, we believe that the reason for the lower media coverage and support for the ZLZD proposal is that it introduces the ESOP model, which is less familiar and more technically demanding for the Slovenian public compared to the model introduced by the ZUDOND proposal, even though adopting the ZLZD would mean a practical systemic regulation of the field. Therefore, at the IED, we believe that raising awareness about the ESOP model and the ZLZD law proposal among relevant stakeholders and decision-makers is the first step in gaining support and empowering stakeholders and beneficiaries of the law for advocacy and law support. Through an awareness-raising and advocacy campaign, we aim to bring the ZLZD proposal to a public debate and subsequently to its adoption. Thus, at the IED, we assess that organized, public pressure on decision-makers is essential to recognize the need and urgency of adopting the ZLZD.

ACHIEVEMENTS:

We established the Coalition for Employee Ownership with at least five initial members (one NGO/business organization, one local stakeholder, one from the financial sector, one entrepreneur, and one academic). We acquired 15 additional signatories of the supporting letter and coalition supporters. We issued two newsletters to promote the coalition and support for the law.

We created and promoted a website for the Coalition for Employee Ownership, published 15 multimedia posts as part of a digital advocacy campaign for LinkedIn and Instagram, and released media articles about the supporters. We presented the law and the coalition at a public event with at least 100 stakeholders.
